Mark W. Smith appeared on behalf of medical practice High Definition MRI, P.C. before the Appellate Division, First Department, in Manhattan, in the case of High Definition MRI, P.C. v. Travelers. Finding in favor of the medical practice, the court concluded that High Definition had stated viable causes of action before the New York Supreme Court for breach of contract and for a declaratory judgment. The Appellate Division reversed and remanded the case for further proceedings.

Smith appeared before New York's Appellate Term, Second Department, in Brooklyn, and argued on behalf of Andrew Carothers M.D., P.C., against over 50 of the nation's largest insurance companies in the precedent-setting case concerning New York's No-Fault law, Andrew Carothers, M.D., P.C. v. Progressive, et al. The appeal arose from a month-long jury trial in New York City, the first jury trial applying the precedent-setting New York Court of Appeals decision in State Farm v. Mallela, 4 N.Y.3d 313 (2005). The Mallela decision addressed the doctrine of "fraudulent incorporation" of medical practices.

Smith Valliere Appears on Front Page of New York Law Journal For Handling the Largest No-Fault Trial in American History

A story appearing on the front page of the New York Law Journal highlighted the firm's representation of a large medical practice against the interests of over 100 of the nation's largest insurance companies in a landmark trial on New York’s No-Fault insurance law. The Appellate Term, Second Department, agreed with the arguments made by Smith Valliere that the trial court wrongly allowed into evidence before the jury the repeated reading of deposition testimony that consisted only of the deponents’ invocations of their Fifth Amendment right against self-incrimination.  However, despite the trial court wrongly allowing the jury to hear such Fifth Amendment invocations hundreds of times during trial, in a 2-1 decision the divided Appellate Term found the error to be harmless. Mark W. Smith was quoted in the piece, stating that "[t]he case law fully supports our client that error regarding adverse inferences . . . cannot be viewed as harmless but warrants a new trial." Smith Valliere filed a lawsuit on behalf of New York State energy consumers, alleging the Regional Greenhouse Gas Initiative was implemented in the state without legislative support. As of June 2011, the program had generated $321 million in unauthorized tax revenue. Mark Smith was quoted in Law 360 stating that "The alleged purpose behind RGGI is to reduce carbon dioxide emissions, but the reality is that it has become a large energy tax imposed illegally on New Yorkers." Smith Valliere filed a lawsuit on behalf of client Larry Blatterfein, in federal court, charging New Brunswick Mayor James Cahill with violating Blatterfein's first amendment constitutional right to free speech by holding up the transfer of a liquor license. Mayor Cahill, a known Boston Red Sox fan, admitted he does not like the name of Blatterfein's new bar, Buck Foston. Mark W. Smith was quoted in the New York Post on June 23, 2011 saying "Buck Foston's is a fun play on words that pays homage to the century-old rivalry between New York and Boston teams." Smith also stated that the mayor should "welcome a new business generating 75 jobs...[he] is placing his personal sensitivities above the needs of constituents."
